Terms of service

These terms are an agreement between you and Futsy ("we", "us", "our"), operated from Melbourne, Victoria, Australia. They govern your use of the Futsy web app and website — a platform for organising futsal leagues: fixtures, teams, RSVPs, substitute matching, results and ladders.
By creating an account or using Futsy you agree to these terms and to our Privacy Policy, which explains how we handle your personal information.
We have written these terms in plain English on purpose. Nothing in them excludes, restricts or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded — see Section 10 first if you read nothing else.
1. What Futsy is (and is not)
Futsy is league management software. We provide the scheduling, team management, RSVP, substitute-matching, results and communication tools that leagues run on.
Futsy is not the organiser of your competition and not the operator of the venue where you play. Your league is run by a league operator — a venue, club or organiser who uses Futsy to administer it. The league operator, not Futsy, is responsible for:
- the competition itself: rules, divisions, scheduling decisions, refereeing, and disputes about results or conduct on the court;
- the physical venue: its safety, condition, insurance, and compliance with Victorian occupational and sporting regulations;
- player fees charged by the league (unless stated otherwise at checkout, payments you make for playing are to the operator, not to us);
- decisions to admit, suspend or remove players from their competition.
When you play futsal, you are participating in a physical sport organised by your league operator at their venue. Any waiver, insurance arrangement or injury policy for the games themselves is between you and the operator or venue.
2. Eligibility and your account
- You must be 16 or older to create your own account. Players under 18 may only be registered with the consent of a parent or guardian, as described in our Privacy Policy.
- You must give us accurate information — your real name, and an email address you control. Futsal is played in person; anonymous or impersonated accounts break the product for everyone else.
- Sign-in is by magic link sent to your email. You are responsible for keeping access to that email account secure, and for everything done through your Futsy account. If you think your account has been compromised, tell us immediately and we can revoke all of its active sessions.
- One account per person. Don't share accounts, and don't RSVP or accept substitute requests on someone else's behalf without their agreement.
Roles. Depending on how your league is set up you may be a player, a team captain, or a league administrator. Captains and administrators get access to other players' contact details and team management tools; if you hold one of these roles, you must use that access only to run your team or league — not for marketing, scraping or any unrelated purpose.
3. Acceptable use
You must not:
- harass, threaten or abuse other players, captains, administrators or referees through the platform (including in substitute-request notes or any free-text field);
- enter false RSVPs, fake results, or manipulate ladders, statistics or substitute-reliability records;
- accept a substitute request with no intention of showing up — repeated no-shows are recorded and visible to administrators, and may lead to suspension;
- use another player's contact details obtained through Futsy for anything other than organising games;
- probe, overload, scrape or attempt to bypass the security of the service (including rate limits and database access controls);
- use Futsy to run any competition or activity that is unlawful in Victoria or wherever your league operates.
Content you submit. Futsy involves limited user content: your profile details, notes on substitute requests, and results entries. You keep ownership of what you submit and grant us a non-exclusive, royalty-free licence to store, display and process it as needed to run the service (for example, showing your name on a fixture). We may remove content that breaches these terms. To report abusive content or behaviour, email us (Section 12) — we review reports within 2 business days, and sooner for safety issues.
4. Fixtures, RSVPs and the substitute system
- RSVPs and substitute acceptances are commitments to real people who are hiring courts and fielding teams. Treat them accordingly.
- The find-a-sub feature shares your name, position and availability with captains looking for a substitute, and records whether you played the games you accepted. This reliability record is visible to league administrators and affects whether you are offered future substitute spots.
- Fixture times, cancellations and results are controlled by your league operator. Futsy transmits this information; we are not responsible for a venue closing, a fixture moving, or a result you disagree with — raise those with your operator.
5. Fees, payment and refunds
For league operators. Futsy is offered as a paid subscription, billed in Australian dollars through our payment processor, Stripe. By subscribing you authorise recurring charges to your nominated payment method at the interval shown at checkout, until you cancel.
- Price changes: we will give you at least 30 days' written notice before any price increase, and it will take effect from your next billing period after the notice — never mid-period. If you don't accept the new price, cancel before it takes effect and you pay nothing further.
- Cancellation: you can cancel at any time from your account settings or by emailing us. Cancellation takes effect at the end of the current billing period; you keep access until then. We don't do lock-in contracts or cancellation fees.
- Refunds: if Futsy has a major failure — it is materially unavailable or does not do what we advertised — you are entitled to a refund under the Australian Consumer Law, and we will honour that without argument. For minor problems, we will fix the issue within a reasonable time. We do not refund simply for change of mind on time already billed, but we also do not charge past your cancellation.
- Failed payments: if a charge fails we will retry and email you. If payment remains outstanding for 14 days we may suspend the subscription until it is resolved. We will not delete your league's data because of a billing lapse — see Section 8.
- GST: prices are stated inclusive or exclusive of GST as shown at checkout; tax invoices are available.
For players. Player accounts are free. If your league operator charges you to play, that fee is set, collected and refunded (or not) by them under their own terms — Futsy is not a party to it.
Chargebacks: if you dispute a charge with your bank instead of contacting us first and the charge was valid, we may suspend the account involved while it is resolved. Please talk to us first — genuine billing errors get refunded faster than a chargeback resolves.
6. Service availability
We aim to keep Futsy available and working, and we monitor errors and outages. But we are a software service, not a utility: we do not promise uninterrupted or error-free operation, and we may need to take the service down briefly for maintenance (scheduled maintenance will be done outside peak fixture hours where practicable). This clause does not limit your Australian Consumer Law guarantees — a service that fails to meet them attracts the remedies in Section 10 regardless of what this paragraph says.
7. Your data
Your personal information is handled as described in our Privacy Policy, including your rights to access, correct, export and delete it. Two points worth repeating here:
- Account deletion erases your contact details and de-identifies your profile, but de-identified match results remain in league history so other players' records stay intact. If you are a team captain you must hand over the captaincy before deleting.
- League operators are responsible for having players' consent before registering them, and must only use player data to run their competition.
If you close a league operator subscription, we will make the league's data available for export for 60 days after the subscription ends, after which we may delete it.
8. Suspension and termination
We may suspend or terminate your account if you materially breach these terms — for example harassment, results manipulation, misuse of other players' contact details, or attempts to compromise the service. For anything short of serious or dangerous conduct, we will warn you and give you a chance to respond before terminating.
Appeal: if your account is suspended or terminated and you believe we got it wrong, email us within 30 days. A human will review the decision and reply with reasons.
You may stop using Futsy at any time. Players can delete their account in-app; operators can cancel their subscription as described in Section 5. On termination, Sections 3 (content licence, limited to existing league records), 7, 10 and 11 continue to apply.
We will never terminate an operator's account without cause and without notice — if we ever discontinue Futsy entirely, we will give operators at least 60 days' notice and a full data export, and refund any pre-paid period we don't deliver.
9. Intellectual property
Futsy — the software, design, name and logo — belongs to us. We grant you a personal, non-transferable licence to use it for organising and playing in futsal competitions while these terms apply. You must not copy, resell, or offer Futsy (or data extracted from it) as your own service. Feedback you send us can be used to improve the product without obligation to you.
10. Australian Consumer Law and liability
Your consumer guarantees are untouched. Under the Australian Consumer Law, our services come with guarantees that cannot be excluded: they must be provided with due care and skill, be fit for the purpose we advertise, and be delivered in a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or your remedies for their breach.
Where the law allows us to limit liability (which, for services not of a kind ordinarily acquired for personal use, the ACL permits under s 64A), our liability for a failure is limited, at our option, to resupplying the service or paying the cost of having it resupplied. This limitation does not apply where it would be unfair or where the failure is a major failure under the ACL.
What we are responsible for: the Futsy software doing what we advertise, handling your data as our Privacy Policy states, and processing operator payments correctly.
What we are not responsible for (because they are outside our control and are the league operator's or venue's domain): injuries or incidents during games, venue conditions, refereeing and competition decisions, fees charged by operators, and the conduct of other players — though we will act on reports of platform-based misconduct as described in Section 3.
Neither of us is liable to the other for consequential loss (lost profits, lost opportunity) except where the ACL or other law says otherwise. Nothing in these terms limits liability for fraud, or for death or personal injury caused by our own negligence.
11. Governing law and disputes
These terms are governed by the laws of Victoria, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
Before going to a court or tribunal, contact us — most problems are billing or account issues we can fix in days. If we can't resolve a dispute between us within 30 days of you raising it, either of us may pursue it formally. Consumers in Victoria can also contact Consumer Affairs Victoria (consumer.vic.gov.au, 1300 558 181) or bring eligible claims in VCAT. Nothing in this section prevents you from complaining to the OAIC about privacy (see the Privacy Policy) or exercising any statutory right.
12. Changes to these terms
We may update these terms as the product evolves. For material changes — anything affecting fees, your rights, liability, or how disputes work — we will give you at least 14 days' notice by email and in-app before they take effect, and for operators no fee-related change will apply until your next billing period. If you don't agree with a change, stop using the service (and cancel any subscription) before it takes effect; we'll refund any pre-paid unused period affected by a material change you reject. Minor clarifications take effect on posting. Previous versions are available on request.

If any part of these terms is found invalid, the rest still applies. These terms plus the Privacy Policy are the entire agreement between us about the service, except that nothing here overrides your non-excludable statutory rights.
